These Website Terms of Use explain the terms that apply when you use our website, submit an enquiry, request a quote, book a plumbing service, communicate with us, respond to our advertising, or receive SMS or email communications from us.
In these Terms, “we”, “us” and “our” means HAY, TIMOTHY JAMES ABN 34 934 116 758 trading as Hay Plumbing Co.
By using our website, submitting an enquiry, accepting a quote, booking a service, or continuing to communicate with us, you agree to these Terms.
The information on our website is provided for general information only. It is intended to help you understand our plumbing services, service areas, contact details and booking options.
While we aim to keep our website accurate and up to date, we do not guarantee that all information will always be complete, current or suitable for your specific property or situation.
Our website content is not a substitute for an inspection, diagnosis, quote or professional advice specific to your plumbing issue.
When you submit an enquiry, request a quote, call us, send an SMS, send an email or complete a website form, you agree that we may contact you using the details you provide.
We may contact you by phone, SMS, email or other electronic communication about your enquiry, quote, booking, appointment, plumbing service, invoice, review request or related matter.
Submitting an enquiry or booking request does not guarantee that a booking has been accepted. A booking is only confirmed when we accept it by phone, SMS, email, calendar confirmation or another clear communication.
Any quote or estimate we provide is based on the information available to us at the time. This may include information you provide, photos or videos you send, visible site conditions, a phone discussion, an online enquiry or an in-person inspection.
Unless stated otherwise, quotes are valid for 30 days from the date they are issued.
A quote may change if the information provided to us is incomplete, inaccurate or misleading; if hidden issues are discovered; if site conditions differ from what was expected; if additional work is requested; if materials or supplier costs change; or if safety, access or compliance issues affect the work required.
Where practical, we will let you know about any material change to the scope or price before carrying out additional work.
The exact scope of work, price, timing and inclusions for a plumbing job will be determined by the quote, invoice, booking confirmation, written contract or other written communication provided to you.
Service descriptions on our website are general descriptions only. They do not guarantee that a particular service is suitable for your property or that a particular outcome can be achieved without inspection, diagnosis or further work.
We aim to provide our services with due care and skill, within a reasonable time and in accordance with applicable laws and standards.
You agree to provide accurate and complete information about the plumbing issue, property, access requirements, known hazards, existing damage, previous work and anything else that may affect the job.
You agree to provide safe and reasonable access to the property and work area, including access to water, electricity, drainage points, fixtures, appliances, meters, isolation valves and any other areas reasonably required to complete the work.
You are responsible for removing or protecting personal items, furniture, vehicles, pets, valuables, fragile items or other property that may obstruct access or be affected by the work.
If we are delayed, prevented from working, required to return, or required to carry out additional work because of inaccurate information, unsafe conditions, poor access, obstructions or hidden issues, additional charges may apply.
Plumbing work may reveal hidden or pre-existing issues that could not reasonably be identified before work began. These may include corroded pipes, damaged drains, tree root intrusion, defective fittings, poor previous workmanship, illegal work, concealed leaks or other hidden defects.
Unless expressly stated in writing, our quote does not include fixing hidden or pre-existing defects that are discovered after work begins.
If hidden or pre-existing issues are discovered, we may recommend additional work. Any additional work may be quoted or charged separately.
Blocked drains can be caused by underlying issues such as tree roots, collapsed pipes, damaged pipework, foreign objects, grease build-up or poor installation.
Where we clear or attempt to clear a blocked drain, this does not guarantee that the blockage will not return.
If you choose not to proceed with a recommended CCTV inspection, further diagnosis, repair or replacement, we are not responsible for recurring issues caused by underlying defects that were not fully investigated or repaired.
If you ask us to use materials, fixtures, fittings, appliances, parts or products supplied by you, you are responsible for ensuring they are suitable, compliant, undamaged, compatible and available on time.
We may refuse to install customer-supplied materials if we reasonably believe they are unsafe, unsuitable, non-compliant, defective or incompatible.
We do not provide any warranty for customer-supplied materials. Any warranty for those materials is between you and the supplier or manufacturer.
You agree to pay the amounts set out in our quote, invoice, booking confirmation, written contract or other agreed communication.
Unless otherwise agreed in writing, payment is due on completion of the work or on receipt of invoice.
For larger jobs, deposits, staged payments or progress payments may be required. Any required payment terms will be communicated before the work proceeds.
If payment is not made by the due date, we may suspend further work, recover reasonable debt collection costs, and take steps to recover the outstanding amount.
To the extent permitted by law, materials supplied by us remain our property until paid for in full.
You should notify us as soon as possible if you need to cancel or reschedule a booking.
If you cancel after materials have been ordered, subcontractors have been booked, travel has commenced, or time has been allocated, you may be charged reasonable costs we have incurred.
If we attend the property and cannot access the work area, cannot contact you, or cannot complete the job due to circumstances within your control, a call-out fee, attendance fee or reasonable costs may apply.
Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other rights that cannot lawfully be excluded.
If you believe there is a defect in our workmanship, you should notify us as soon as reasonably possible and give us a reasonable opportunity to inspect the issue and, where appropriate, rectify it.
Any workmanship warranty we provide applies only to the work performed by us. It does not apply to customer-supplied materials, pre-existing defects, misuse, lack of maintenance, third-party work, normal wear and tear, recurring blockages caused by underlying defects, or issues caused by circumstances outside our reasonable control.
Where required by law, a separate written contract may be required for residential building work or specialist work.
These Website Terms of Use do not replace any written contract, statutory notice, insurance requirement, cooling-off right, consumer building guide or other document that may be required under applicable building, plumbing or home building laws.
If there is any inconsistency between these Terms and a signed written contract for a particular job, the signed written contract will apply to the extent of the inconsistency.
By submitting an enquiry, booking a service, accepting a quote or otherwise providing your contact details, you agree that we may contact you about your enquiry, booking, service, quote, appointment, invoice, customer support, review request or related services.
Where permitted by law, we may also send you marketing or promotional communications about services that may be relevant to you.
You can opt out of marketing communications at any time by using the unsubscribe link, replying “STOP” to SMS messages where available, or contacting us directly.
Even if you opt out of marketing, we may still send you non-marketing communications relating to active enquiries, bookings, services, invoices, safety issues, warranties, complaints or legal requirements.
We do not guarantee that SMS, email or other electronic messages will always be delivered without delay, failure or error. Delivery may depend on third-party providers, mobile networks, internet providers, device settings and other matters outside our control.
